Former South African Revenue Services (SARS) Commissioner, Tom Moyane, awaits Court decision on bid to set aside axing as SARS, boss.
The former South African Revenue Services boss, Tom Moyane, last week, approached the High Court in Pretoria to review and set aside the president's decision to dismiss him as SARS boss in order for him to proceed with challenging the lawfulness of the establishment of the Nugent Commission of Inquiry.
Moyane asserts that he has no plans to escape being held accountable but rather wants to appear before a lawfully constituted disciplinary panel of inquiry where he is allowed to defend himself.
Moyane asked the court to return the status quo and that he be placed on suspension once again. He also asked Judge Hans Fabricius to prohibit the Nugent commission from delivering its final report to President Ramaphosa.
South African President, Cyril Ramaphosa axed Moyane in September after accepting the recommendation made by retired Judge Robert Nugent in his interim report.
This application to the Court is likely to be Moyane's last resort to regaining his job. If not granted by the court, a new permanent head for the South African Revenue Service (SARS) would have to be appointed by President Ramaphosa.
